General Terms and Conditions

Scope

1. Inavarde Wines Fabio Bolognese, Holderäckerstrasse 3a, 5442 Fislisbach, Switzerland (hereinafter also referred to as “Inavarde Wines”, “Inavarde”, “we” or “us”) operates an online shop for goods at https://inavarde.wine. These Terms and Conditions apply to all services between Inavarde and our customers (hereinafter also referred to as “customer”, “end consumer” or “you”) in their version valid at the time of the order, unless otherwise expressly agreed between the parties.

2. The following terms of sale are directed exclusively at end consumers.

3. Inavarde Wines does not participate in dispute resolution proceedings before a consumer arbitration board.

Conclusion of Contract

1.The purchase contract is concluded with Inavarde Wines Fabio Bolognese, Holderäckerstrasse 3a, 5442 Fislisbach, Switzerland.

2. The presentation of products in the online shop is for informational purposes only and does not constitute a legally binding offer. By ticking the checkbox “I have read and understood the Terms and Conditions” and clicking the “Buy” button, you submit a binding order for the goods contained in your cart. After submitting your order, you will receive an order confirmation by email, which does not yet constitute acceptance of the contract. The contract is considered accepted by Inavarde when either (a) an order confirmation is sent by email or (b) the goods are delivered.

3. If an item marked as available on the website is not deliverable, it will be delivered as soon as possible. If a replacement or subsequent delivery is not possible, we are entitled to withdraw from the contract and will inform you immediately about the unavailability and refund any payments already made.

Youth Protection

1. By placing an order with Inavarde Wines, you confirm that you are at least 18 years old.

2. As a customer, you are obliged to ensure that only you or a duly authorized adult person receives the delivery. The logistics provider or transport company is entitled to request proof of age upon delivery.

Prices and Delivery

1. The prices shown on https://inavarde.wine
 and shipping costs are total prices and include all price components, including all applicable taxes.

2. The customer must pay the purchase price before delivery unless Inavarde explicitly offers purchase on invoice. Available payment methods are shown in the online shop and/or in the respective offer.

3. By placing an order, the customer agrees that Inavarde may share their telephone number and/or email address with the shipping company so that it can inform the customer about the estimated delivery time. The customer may object to this by emailing info@inavarde.wine. However, shipment status notifications will then no longer be possible.

4. If a package is returned to Inavarde due to an incorrect address provided by the customer, the customer remains responsible for the shipping costs.

5. If you live in a country where additional taxes or duties may apply for receiving alcohol, you are responsible for declaring and paying these. By purchasing wines from Inavarde, you accept full responsibility for any such charges, and Inavarde does not cover them.

Retention of Title

Goods remain the property of Inavarde Wines until full payment has been received.

Right of Withdrawal

Liability and Warranty

1. Our liability is limited to (a) breaches of contractual obligations and (b) intentional or grossly negligent conduct.

2. Warranty is governed by the statutory provisions of Switzerland.

3. For business customers, the warranty period for delivered goods is 12 months.

4. Please inspect goods upon delivery according to the delivery note. Shortages or breakage must be reported within 24 hours of receipt. Otherwise, we cannot provide replacement or compensation.

5. Complaints of any kind must be sent immediately by email to info@inavarde.wine.

Natural Wines and Wine Faults

1. All wines in our assortment are natural wines, which may differ significantly from conventional wines. Flavors may appear unusual to inexperienced wine drinkers.

2. Natural wines may be cloudy and contain sediment. They may vary from bottle to bottle. These characteristics are typical and not grounds for complaint.

3. All wine purchases made via https://inavarde.wine
are final. Opened bottles cannot be returned.

4. Under the revised EU Consumer Rights Directive, your right of withdrawal generally expires no later than 12 months and 14 days after receipt of the goods. Cork-related complaints for purchases prior to this period are legally settled. Please understand that we do not replace bottles purchased more than six months ago.

Storage of Contract Text

Your order data is stored by Inavarde Wines. You may print your order confirmation if you wish. You will receive all relevant order information by email.

Contract Languages

The languages available for concluding the contract are English and German.

Miscellaneous

Product colors shown online may differ from the original due to lighting conditions, monitor settings, graphics quality, etc.

Severability Clause

If any provision of these Terms and Conditions is invalid, the remaining provisions remain unaffected. The invalid provision shall be replaced by applicable statutory law.
